Hello TT Faculty members,

The fact-finding hearing before Mr. Barton Bixenstine took place on April 22nd and 23rd. As requested by Mr. Bixenstine in a March 8th email to the parties, AAUP-KSU submitted its fact-finding position statement to Mr. Bixenstine with a copy to the University on April 18th. The administration chose not to submit a pre-hearing position statement. (Both parties submitted a pre-hearing statement in 2015.)

The parties engaged in a mediated bargaining session assisted by Federal Mediator Brittney Howard on March 26, 2019.  This session did not result in any significant progress toward an agreement on a successor to our 2015 Collective Bargaining Agreement.  At this time, no future sessions are planned.  The fact-finding hearing is scheduled for April 22nd before Mr. Barton Bixenstine.  At that hearing, Mr. Bixenstine will consider the evidence presented by both parties and issue a report outlining his non-binding proposal for a fair settlement on the outstanding issues.  AAUP-KSU will then conduct a vote of our dues paying membership on whether or not to accept the fact-finder’s report.  At the same time, the Board of Trustees will vote on the fact-finder’s report.

The parties engaged in a mediated bargaining session assisted by Federal Mediator Brittney Howard on March 11, 2019.  At this session, the administration presented formal proposals for the three outstanding Articles: Article XII (Salary), Article XIII (Medical Benefits), and Article XIV (Other Benefits).  AAUP-KSU provided a counter-proposal on Article XIV.

As you are aware, AAUP-KSU sent out a communication on February 25th, 2019, inviting Faculty to participate in informational picketing during the Board of Trustees meeting on Wednesday, March 6th in order “to voice their support of a fair contract for the Faculty at Kent State and to urge the administration to return to the table.”  The communication went on to state that “[t]o date, AAUP-KSU has not received any communication from the administration regarding future meetings between the parties or any other response to AAUP-KSU’s proposals.”

The parties engaged in a mediated bargaining session assisted by Federal Mediator Brittney Howard on January 23, 2019.  At this session, AAUP-KSU agreed to accept the administration’s proposal of November 21, 2018 for Article II (Recognition and Dues Deduction), and the parties signed a tentative agreement on that article.  The only Articles that remain in dispute are the three economic Articles XII (Salary), XIII (Medical Benefits), and XIV (Other Benefits).  While some progress was made at the mediated session, the movement on the part of the administration was insufficient to make AAUP-KSU optimistic that the impasse on the three economic articles can be resolved at the table.

AAUP-KSU was surprised to read in the “Collective Bargaining Management Update - Jan. 17” that the administration is asserting that no proposals have been exchanged on the issue of making any standard increment (across the board) raises for AY 18/19 retroactive to the beginning of the academic year. AAUP-KSU’s proposals on Article XII (Salary) of August 24th, October 10th, and November 27th have all contained the following language: “This standard increment will be retroactive to the start of the 2018-2019 academic year contract”(see section  5.A.1 of each proposal).

The parties engaged in three mediated bargaining sessions assisted by Federal Mediator Brittney Howard on November 28, December 11, and December 17, 2018.  Despite the best efforts of Ms. Howard, these sessions did not produce any meaningful movement on the part of the administration.  On December 20, AAUP-KSU formally exercised its contractual right (per Article XXIV, Section 3.A) to request fact-finding on the outstanding issues.  An additional mediated session is scheduled for January 23, 2019.

The parties met on November 21, 2018 for a final bargaining session prior to our first session with Federal Mediator, Brittney Howard, which will take place on November 28, 2018.  Although the administration presented counter-proposals on Article II (Recognition and Dues Deduction) and Article XIII (Medical Benefits), the proposals do not reflect any movement relative to earlier administrative proposals.  The language the administration presented for Article II was identical to their proposal of August 24th.  Their proposal on Article XIII differed from their original proposal of August 9th only in that it reflects the reality that, since the parties weren’t able to reach an agreement before open enrollment, our current healthcare benefits will continue into 2019.

I regret to inform you that AAUP-KSU has now officially invoked its right to declare impasse under Article XXIV, Section 3.A of the CBA and will be inviting assistance by the Federal Mediation and Conciliation Service.  AAUP-KSU also plans to invoke its right under Article XXIV, Section 3.A to request fact-finding on the outstanding issues.  Such a request may be made no earlier than 14 days nor later than 28 days after the first mediated negotiation session.

I’d like to provide you with an update on the status of the negotiations for a successor to our 2015 contract.  Since our last update, the parties have met three times: September 19th, September 26th, and October 10th.  I regret to inform you that very little progress was made at any of those meetings and it is increasingly likely that we will end up in fact-finding as we did in the 2015 negotiations.  The parties will meet again on October 24th.

I’d like to provide you with a brief update on the status of the negotiations for a successor to our 2015 contract.  Things are continuing to proceed more slowly than we would prefer.  Since my last update, the parties have met just twice: on July 19th and July 25th.  Sessions previously scheduled on July 27th and July 31st were cancelled at the administration’s request.  The parties are scheduled to meet next on August 9th and August 14th.
